過払い金訴訟での【共同訴訟】にていての質問です。完済済みの3社相手に共同訴訟を予定してます。初めての訴訟では、共同訴訟おススメしないと本やネット記載してあるのを見て、通常の1社づつの訴訟にするか迷ってます。共同訴訟については、メリット・デメリットはある程度調べてみましたが、なにせ初めての訴訟なので、アドバイスなどあると有り難いです。宜しくお願い致します。＊争点は特にありません。
私も3社の案件がありました。まず手始めに1社提訴してみました。すんなりと話が進んだので、意外と大丈夫かな。と思い、切手代等が節約できると考えて、残り2社は共同訴訟にしました。訴状を書く際、手間取りましたがいろいろ参考に書き上げました。そして提出。無事受け付けてもらったのですが・・・第1回口頭弁論の際に裁判長より「今回はこれで受け付けましたが、もし次回があるのであれば個々の訴えに直接の関わりがないのであればそれぞれ個別に訴状を作るようにしてください。」と言われてしまいました。。「共同訴訟」知らないはずないと思うので、よく分からないのですが… あまりよく思われない方もいることもあるようです。
