現在、司法書士に過払い請求の依頼をしております。相手はアコム、プロミス、アイフルの3社です。 7月初旬に依頼し、22日に司法書士から連絡があり(この時点で取引履歴開示、見直し計算は完了、各社に連絡済)、アイフルからは和解の連絡があったそうですが、満額に近い額を回収するために、訴訟をすすめられ、お願いする事にしました。8月初旬に裁判所に提訴するそうです。そこで過払い請求の経験がおありの方に質問ですが、訴訟をおこしてから、過払い金の返還まで、各社どれくらいの期間が必要でしょうか？司法書士の話では、たいした争点もないそうです。過払いの金額でも期間に差があるかもしれませんが、おおよその期間を教えていただけないでしょうか？
私も４件の過払い金請求の訴訟経験があります。ケースバイケースですが、裁判所に提訴してから、実際に裁判まで約１ケ月程度、裁判により特に争点がないようでしたら、即時判決で判決内容は郵送にて約１週間以内に原告・被告に送られることになります。その後過払い金が返還されるまでは各社差がありますが、概ね１～２ヶ月以内だったと思います。おおよそ３ヶ月前後みておけば宜しいのではないかと思います。そのうち２件は裁判当日までに再度納得のいく金額で和解という形で書面を交わし解決したところもありました。参考になれば宜しいのですが・・・
