生活保護費の過払い金返還請求についての質問です。

- 生活保護費の過払い金返還請求についての質問です。やっと生活の立て直しが出来て、もうすぐ生活保護から抜け出すことととなりました。しかし、職員のミスで過払いが行われていたことがわかりました。 担当者が代わり、発覚したのですが合計８０万円弱ほどの過払いがあり返還するよう言われています。もちろん分割になりますが やっと社会人復帰できる状態になったのに、多額の借金を負わされた気分で納得いきません。 過払いの一覧表みたいなものを見せられて、合計６件でトータル８０万くらいになっていて私としては少ない金額のものから払い終えて件数を減らし、自分で見やすいようにしたいと申し出たのですが役所としては大きい金額のもので、なお古い年のものから払うようにしないとダメという事でした。 役所が間違えて振り込んでいたものなのに、自分の自由に返金出来ないことも納得いきません。 また、自営業として再出発したのですが必要経費も【絶対に必要な物という証明がないと認めない】と言われました。 自営業なので、コピー、ボールペンから経費ですし特殊な機材はもちろんなのですが「それがなくてもどうにか出来るでしょ？」と言われて困っています。 私としては １．出来れば生活保護を抜けるので、過払い金の返還を免除してほしい 無理なら ２．返還する過払い金の項目（６件）から、自分で返還する部分を選びたい ３．あと数か月の間（委託業務、研修期間を終えるまで）は、少ない額であろうとも経費をきちんと出してほしい。 生活保護を抜けられる状況になって、過払い金がありましたといわれなんだか生活保護から抜けられないような状況にされている気持ちになります。 また、過払い金の返還を今は役所まで支払いに毎月行っている状態なのですが、社会復帰しても通わなくてはいけないのでしょうか？出来れば引き落としのような形にしてほしいです。 まさか、一括で支払えとは言われないですよね？ 分かる範囲でお教え下さい。よろしくお願い致します。
- ▼捕捉に対する回答です。<m(__)m> >>３年間のトータルで一覧表には詳細な内容が記載されておらず、口頭での説明だったの まず、委細については文書でくれやと言って下さい。 福祉事務所では、文書を求められたら文書を交付しなければならない決まりになってますので、多額の返還要求であれば、尚更明朗会計で隅々までガラス張りと言うような状態で明確にされてなくてはなりません。 そうでなければ貴方も到底納得できないでしょうからね。誰でもその辺は同じです。 >>子供の手当でした。 明らかにCWの制度変更に基づく不勉強等が原因による計算ミスだろうと推察します。 >>なにか良い解決方法はありますでしょうか？ これについては前回の回答通りが原則となります。(@_@")b"" 従って、実際に余計に貰ってしまわれていたと言う事実も勿論ありますが、しかし、貰ったモンを全て貯蓄もせず使い切ってしまわれていたと言うような貴方の世帯全体に対する保護費として給付されたお金の計画的な運用上の問題と言う事実も同時にあると言う事を貴方は認識すべき所でもあります。 貰ったモノを全額綺麗に使い切ると言うのは、これは自立へ向けた計画的な生活費の運用と言う観点からすれば、及第点所か50点位の見方にしかならないのです。もう少し厳しい目で見れば４０点位です。 もしマイナスで足りないとなればもう赤点で、この水準になると、流石にもうお金を自己管理して自立へ向けての計画的な運用は出来ないと言うような判断をされかねないような事にもなってきます。 ま、貴方は自営をするなら必要経費は必要経費として漏らさず計上して控除を考えつつ、後は福祉事務所と貴方の間で過払いに対する問題については、担当職員の責任を追及しつつも再発防止策を求めての再教育の徹底を行わせるように示唆したり、ある程度過払い金に対する減免措置は自立に大きく寄与すると言うような事でも訴えるかして少し金額を減免して貰うかする程度です。 因に、過払い金が発生して返還対象となった場合でも、減免や免除をする事が自立へよりつながると言うような裁定が行われたりした場合、減免や全額免除と言うような決定になり貰い得と言うような着地点に落ち着く場合はあったりします。 ただねぇ、この辺は貴方と福祉事務所側との交渉次第なんですよね。^_^; 貴方に相手をウンと言わせて納得させられるだけのモノがあれば良いんですが、最初の回答時に私は貴方の書かれている文書から酌み取れるニュアンスや印象からは、貴方にそれだけのモノは無いだろうとの判断をしておりましたから、このような路線の回答は省略してカットしてたんですね。 ま、恐らく全額免除は難しいでしょうから、少しでも割り引いて貰えるようにでも上手く交渉されるなり頑張ってみると宜しいかと。 ▼捕捉前の回答です。<m(__)m> >>担当者が代わり、発覚したのですが合計８０万円弱ほどの過払いがあり返還するよう言われています。 どんなモノで期間はいつ頃からのような内訳になってますか？ また、８０万と言うのは過払いになってる金額で満額でしょうか？ それを先に捕捉されて下さい。
