- 【消費者金融】過払い金・債務不存在での和解交渉について質問いたします。 現在某金融会社1社に借り入れをしています。 借り初めが2008年冬で最初は10万程だったのですが翌年には20万 3年目には30万円になってしまいました。 毎月の支払はほぼ利息だけ（5000円くらい）で過ごしてきてしまったのですが 先々月20万円を返済、先月は6万円を返済しました。 残りは五万ほどなのですが法律事務所さんにざっと過払い金の計算をしてもらってみると 7~8万過払い金が発生する可能性があるという事でした。 支払いが終わったら自分で過払い金請求をしてみようかな、と思っていたのですが 色々調べてみると個人でやった場合、値引き交渉されてしまい全額返金は難しい事や 半年ほどかかってしまう例を拝見しました。 そこで先ほど目にしたのが債務不存在での和解交渉です。 全額返済してから過払い請求を行うよりも 全部返済してしまう前に債務不存在で和解交渉を行う方が簡単だと書いてあったのですが この場合、今月の全額返済の支払いはせずに（または利息分だけ払う） 取引履歴を請求して自分で計算した後にその書類と債務不存在での和解交渉を進めた方がいいでしょうか？ しかしそれがうまくいったとしても、過払い金が本当に8万円あったとしたら約三万円の損になってしまうので 交渉前に過払い金分を（3万円？）借りてしまう（返してもらってしまう）のはいけないやり方でしょうか。 それとも全部払い終わってから法律事務所さんに頼んで手数料がかかっても8万円返金していただく方が いいのでしょうか。。 どなたか詳しい方が居りましたらご教授願います。
