- 財産分与の一部でもらった車の追加装備品を元旦那が立て替えてくれていますが、その支払いでもめています。 去年８月に離婚し、子供２人（うち１人は重度の身体障害児）を私が引き取って、毎日介護のため、働けず、 元旦那からの養育費と慰謝料の分割金と子供の手当金で暮らしています。 離婚時に車の購入金として１００万円をもらう約束で、養育費や慰謝料のことも公正証書に残しました。 しかし元旦那は現金が用意できず、元旦那の名義でローンを組み、車を購入し、私が使っています。 車の名義は元旦那です。所有権がついています。 購入時に追加で障害児の子供の為にと、カーナビとリヤシートにテレビをつけました。 車代と追加費用で１２４万円になり、追加分２４万円は元旦那が支払ってくれました。 その際に、追加分は後日、支払いの相談をする旨、書面でお互いに署名、捺印しました。 毎月、月末に養育費と慰謝料の分割金をもらっています。毎年、６月と１２月は加算分として いただいています。今年の６月は問題なく支払ってもらえたのですが、１２月分の支払日の 今日になって、加算分を車の購入時の追加分として約半額に減額してほしいと連絡してきたのです。 これからも加算月に追加分を減額したいといってきました。 私は「支払日当日の減額は応じられないので、約束した金額を振り込んでください」とメールしました。 その後のことについては、後日相談に応じますと。 しかし、元旦那はこうメールしてきました。 「公正証書に記載されている責務は履行しておりますので、過払いしている現状では 支払い責任がないのは理解していただけますか？年末を控え、一方的に金額を決めてしまうと 迷惑だと思ってご相談しているのをご理解いただけないでしょうか？たしか、過払いの金額を確認した時に、 清算は加算額で調整したい旨を口頭でお話したつもりです。 こちらは相談しているつもりなのに、一方的な決め付けをされてしまうのは残念です」と。 結局は今日、予定通りの金額を振り込んでくれるそうですが、 私が間違っているように言われてしまい、悩んでいます。 元旦那の言い分通りに、今日その場で減額に応じない私が間違っているのでしょうか？ 私は減額に応じないのではなく、まえもって予告がなかったので減額に応じなかっただけなのですが・・・。 どなたかアドバイスをお願いします。長文ですみません。
