完済から５年程経って延滞、分断なしでアコム、プロミス、レイクに過払い金請求を弁護士に依頼しておりました。即、提訴していただき、３回目前に和解したようで、裁判所発行のその旨の内容の書類が弁護士経由で当方に届きました。納得できない場合は2週間以内に連絡をとの事です。元金と最終取引までの利息は満額でしたが支払日までの利息分が2.5％位で満5+5の額からいうと92％強でした。40万円ほど減額です。弁護士に満額（満5+5）は無理かと確認すると「当職では妥当な額での和解で○○県の弁護士（ネットやコマーシャル上での大手は除く）はほぼこのような額（割合）での和解です」との事でした。個人の方で満5+5を返金されたという話を聞きますが、弁護士依頼ですと満5+5は難しいのでしょうか？
和解ならそんなもんてことではないでしょうか。ほんとに何の論点もないなら、判決もらって控訴審もがんばって、というのも選択肢でしょう。もちろん、時間は数ヶ月余計にかかります。あとは弁護士費用でしょうね。弁護士によっては、一般の消費者さんからの依頼は、1審までは頑張ってあげようと、お安めに受任してることもあるでしょう。控訴審いくなら本気でとるぞとか、思っているかも知れません。考え出すと、判決だと強制執行じゃないと払わない業者もいるかもしれない、時間も費用も更にかかる・・・とかキリがないですが。その辺の、リスクやコストについて確認の上、40万円と天秤にかけたら良いのではないでしょうか。
