- 過払い請求裁判・武富士の答弁書について。 本人訴訟で武富士を相手に過払い請求の裁判がはじまりました。 1回目当日に答弁書を受け取り、次回までに準備書面を提出となっています。 相手の答弁書についてですが、被告の主張で「悪意の受益者」について１ページ半ほど主張しています。 平成21年7月10日判決と平成18年12月24日判決を出してきて、悪意の受益者でないという事と、19年7月13日判決により特段の事情があると認めることが相当である。という事を言っています。 答弁書の後半部分に 「２１年7月判決は、期限の利益喪失特約下の支払いの受領ということだけではなく、さらに貸金業者を「悪意の受益者」と認定するためには、過払金の変換を求める者が、制限超過部分の支払について、それ以外の貸金業法４３条1項の適用要件を充足していないことの主張・立証を必要とし、また仮に充足しない適用要件があるとしても、それだけで直ちに貸金業者悪意のなることはなく、その適用要件との関係で貸金業者が悪意の受益者であると推定されるほかの事情を主張立証しなければならないと判示している。」との記載がありました。 この部分についてどのように反論をしたらよいか考えております。 悪意の受益者について、特段の事情について、21年7月判決の部分の準備書面は本やネット等を参考に作成できたのですが、それでよいでしょうか。 一応、「被告が貸金業法４３条の要件事実を充足する適法な要件を具備した書面を原告に交付し，その書面の写しを保管し、訴訟において具体的に主張・立証しない限り、被告には、利息制限法所定の制限超過利息の受領につき、同項の適用があるとの認識を有しており、かつ、そのような認識を有するに至ったことについてやむを得ないといえる特段の事情があったとは言えず、悪意の受益者に該当する」という事と、 「被告は、「１７条書面」及び「１８条書面」の交付を行っていなかった（少なくとも本件訴訟において被告は１７条書面、１８条書面に関する主張・立証をしていない。）」といった事は書きましたが、上記部分について何かさらに書いた方がよいでしょうか？
