- ブラック企業？ 給料日5日前に急な給料の引き下げ、天引きの告知 長文となりますが、よろしくお願いいたします。 夫は美容師（美容師歴15年のベテラン）で、 社長を含め20名程の有名サロンに昨年9月より勤務しております。 入社経緯から詳しく説明しますと・・・ 昨年8月までは違う会社のサロンに店長として５年弱勤めていたのですが、 現在の会社の社長（Ａ氏）からのヘッドハンティングで転職となりました。 以前の会社での役職が店長でしたし、キャリア・技術・顧客数共に実績がありましたので 入社した9月から11月までの3ヶ月間は試用期間という形ではありましたが 基本月給20万円+家族手当1万円+売上歩合給 を支給、 社会保険、厚生年金などもすぐに入れてもらう条件での契約となりました。 現在の会社ではスタイリストの場合、基本月給は18万円からスタートし、 売上実績を積むことで段階的に20万円まで昇給する制度となっており、 当初から最高額の20万円で契約したという事になります。 Ａ氏は夫を幹部候補として迎え入れたいと勧誘の時から話していましたし、 何より夫がアシスタント時代に働いていたお店であったこと、 Ａ氏を当時から尊敬していたこと、 若気の至りで退職してしまった過去に目をつぶって誘ってもらえたこと が嬉しかったようで、恩返しの気持ちもあって転職を決めたのです。 ですが、10年ぶりに勤めてみると、有名サロンとは名ばかりで・・・ 予約が埋まっているにも関わらず新たな予約を詰め込み、お客様を待たせて当たり前。 （予約客でありながら1時間待たせる事など日常茶飯事、カットだけで3時間も店内にいらっしゃる事になってしまう、シャンプーからカラー剤塗りまでの間など施術間で20～30分待たせるなど） 少しでも待たせないように忙しく笑顔無く働くスタッフ達。 待たせない為に少しでも早い施術を求められるため、満足の行く技術を提供できない。 結果として再来率が極めて低く、指名客が付き辛い＝売上歩合給が少ない。 朝から晩まで回し切れない予約がびっしりで、閉店後まで食事する暇も無い。 こんな事が毎日続いており、 夫は長年自分を指名してくださって新たなサロンにも足を運んでくださる 顧客様にも申し訳無い気持ちがつのるばかり。 いつも暗い顔で帰宅し、ため息しか出ず、日に日に痩せ細っていきました。 再来客が少ないので何とか新規客を増やそうと価格はどんどん安くなっていき、 必然的にサロン全体の売上高も目標に満たないわけですから 客数をこなせとばかりに予約の詰め込みがさらにひどくなっていく。 夫も幹部候補として入社した以上はサロンを立て直したいと、 店長や他スタッフ達に改善策を提案したり、 アシスタントの教育係として日付の変わる頃まで残業したり、 Ａ氏に直談判するなどと奮闘してまいりました。 ですが、社長のＡ氏自体の考え方・経営方針が 売上至上主義であることは一向に変わらず、 他スタッフも社長がそうである以上、諦めている人達ばかりで 何も改善される事がありませんでした。 夫が試用期間中に早期退職したいと考えていた昨年11月、 私の親戚が営んでいた美容室が閉店する事が決まり、 その店舗で自分の店をやってはどうか？という話が出てきました。 親戚でしたのでほぼ無償で居抜き物件を譲ってもらえる話で まさに棚から牡丹餅でした。 夫も即座に自分の店を持つ決意をし、 試用期間3ヶ月目に入った昨年11月に退職の旨を伝え、 就業規則に 退職は3か月前までに願い出る事 とありましたので 今年2月まで勤務する事で話がまとまりました。 その後もＡ氏からは、スタッフミーティングなどで ・自分で店を出そうと考える人間は、自分の技術に驕っているだけ ・なけなしの金で店を持って、うまく行くはずがない など、夫の名前は出さないまでも罵倒されるような事を言われ続けました。 それでも夫は文句ひとつ言う事なく勤め続け、 やっと今月末で退職できる・・・あと1ヶ月・・・ というところまで来て、 急な給料の引き下げ、天引きの話をされました。 給料は 月末締め・翌月10日払い です。 Ａ氏の言い分はこちらです。 ーーーーーーーーーー 幹部候補として入社するという話であったから、 最初から基本給は最高額の20万円だったが、 退職が確定した時点で幹部候補では無いから 最低額の18万円に引き下げる。 家族手当1万円も今回支給分から付けない。 試用期間中に支払った売上歩合給については、 本来試用期間中には売上歩合給は付けないが 幹部候補だから支給してきただけ。 今まで払ってきた売上歩合給分は給料過払いとして 今月の給料から天引きする。 もちろん今後の売上歩合給は付かない。 ーーーーーーーーーー このような話を給料日5日前の昨日、急に告知されました。 夫は、もうＡ氏とは何も話したくないと意気消沈していますが、私は納得いきません。 急に今月の給料が手取りで10万円程になる計算です。 急な給料の引き下げ、天引きを撤回させる事はできませんか？
